Welcome to the Vibanx Group’s Privacy Policy. This Policy explains how companies within the Vibanx Group are committed to protecting and respecting your privacy.
The Vibanx Group (hereinafter “Company”, “we”, “us”, or “our”), are the providers of website(s) (including: Vibanx.com, https://go.vibanx.com/, and the Vibanx mobile application), platforms and services (collectively, the “Services“). This Privacy Policy is a legal agreement between you and us. The term “you” refers to the person or entity utilizing the Services. You agree that this Privacy Policy is the equivalent of a written paper agreement between you and us. By utilizing any of the Services you are accepting the practices detailed within this Privacy Policy.
We are committed to collecting, using and distributing Personal Information responsibly and in accordance with this Privacy Policy. This Privacy Policy describes how we collect Personal Information through our Services, as well as how we use Personal Information and the manner in which Personal Information may be disclosed or shared by us.
IF YOU DO NOT CONSENT TO THE COLLECTION, USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY, DO NOT USE THE SERVICES AND DO NOT PROVIDE US WITH ANY PERSONAL INFORMATION.
You bear all responsibility for ensuring that your use of the Services is compliant with all applicable laws and applicable Vibanx Group terms and conditions and security policy, all of which are incorporated herein by reference.
We reserve the right at any time and from time-to-time to modify, edit and update the Privacy Policy and we shall do at our sole discretion. You should review the Privacy Policy regularly to make sure that you are aware of any changes. Your access to use of the Services on and after the date on which we post the revised terms constitutes your acceptance of the Privacy Policy as revised.
About Us
Vibanx Group is comprised of a group of Fintech Companies in our jurisdiction of operation. Vibanx Holdings Ltd., a United Kingdom company, is the parent company of the Vibanx Group, and has operations centralised in London, England. You will be informed of the legal name of which Vibanx Company you have a relationship with when you purchase a product or service from us, as per the operating jurisdiction This company is known as the “Data Controller” of your personal data.
As part of our normal business operations, we collect certain personal data from our clients. This Privacy Notice sets out the legal basis for processing any such personal data or personal information that we collect or that you provide to us. Please read this notice carefully to understand our practices regarding your personal data or personal information.
Applicable Data Protection Laws
The data protection laws applicable to this Privacy Policy (collectively the “Data Protection Laws”) include:

Usually, personal information refers to any information about an identifiable individual or any information that can be used to identify an individual. Personal Information may include, for example, your name and home address, your date of birth, payment information, your occupation, medical conditions or other health information, your personal financial records or credit information, certain video or images of you, or any personal identification numbers. Publicly available information, such as information in a public directory, is not Personal Information under this Privacy Policy.
Consent for the collection, use and disclosure of Personal Information
Privacy laws require us to obtain the consent of an individual to the collection, use or disclosure of Personal Information in many circumstances. Providing us with your Personal Information is always your choice. By accessing our website or submitting your Personal Information through the Services, you consent to the collection, use, and disclosure of such information in accordance with this Privacy Policy and as otherwise permitted or required by law.
When we receive Personal Information from you or collect personal information relating to you, for the purposes of providing you with our Services, or for other uses identified herein, including but not limited to information you provide in relation to your account (e.g., registration details and information regarding the use of your account), you are providing us with consent as follows:
i. to allow us to deal with that Personal Information in a reasonable manner, and to deal with Personal Information as set out in this Privacy Policy;
ii. to allow us to provide your Personal Information to third parties we engage to provide or support the Services, including our regulated payment provider and us;
iii. to allow us to use and store your Personal Information for the purpose of providing you with the products and services you purchase from us and to utilize the Services, including your account;
iv. to allow us to transfer your Personal Information outside of the jurisdiction from which you provide any such Personal Information, whereby your Personal Information will be treated in accordance with applicable laws of the jurisdiction to which it is transferred, for the purpose of storage, processing and use of your Personal Information by us; and
v. to enter you into a contract with our regulated payment provider and us.
If you need to provide us with Personal Information about other individuals, you hereby represent and warrant to us that, where required by law and prior to your disclosure to us, you will obtain the consent of each individual to the collection, use and disclosure by us for the specific purpose(s) that the disclosure is made by you, including all purposes set out herein.
You hereby consent to the transfer of your Personal Information and all information you provide to us, to our successor, a third-party or us, as applicable, for use for the same purposes as set out in this Privacy Policy if:
a. we sell our organization or merge with any third party;
b. we sell any business assets;
c. we buy any business or assets; or
d. either Vibanx Canada Limited or any other Vibanx Group member, or substantially all of its assets, are acquired by a third party.
If any of the above-referenced events occur we may disclose your personal information to the third party with which we engage in relation to any of the foregoing, or your personal information may be transferred to us, as applicable, and your personal information may be deemed to be a business asset or be a transferred asset in relation to any of the foregoing, as applicable.
Consent Exceptions
There are legal exceptions where we will not need to obtain consent or explain the purposes for the collection, use or disclosure of Personal Information. Some examples of situations where consent is not required include an emergency that threatens the life, health or security of an individual, or if we must comply with a court order or governmental order.
We may use Personal Information without your knowledge or consent in limited circumstances whereby we are required to provide Personal Information to third parties for legal or regulatory purposes. For example, under certain exceptional circumstances we may have a legal duty or right to disclose Personal Information without your knowledge or consent. Various government agencies such as the Canada Revenue Agency, Human Rights Commission, Canadian Radio-television and Telecommunications Commission, and law enforcement, may have the authority to review our files and interview our staff when deemed necessary. These agencies have their own strict privacy obligations.
What information do we collect?
We collect information provided by you when you sign up for an account, complete a transaction through the Services, or fill out a form on the Services and we may collect information from you at other instances in the course of and in relation to the Services. For example, we may collect your name, address, telephone number, e-mail address or other information when it is submitted to us via the Services. When completing any forms or otherwise using the Services, as appropriate, you may be asked to enter your name, e-mail address, mailing address, phone number, payment information and other Personal Information. What do we use your information for?
We use your Personal Information for the purposes for which it was collected, as well as other purposes for which you have given consent. In addition to those purposes set out in the Consent section above, this includes, but is not limited to, the following purposes:
• Marketing: In accordance with applicable anti-spam laws, we may obtain your consent in order to send you commercial electronic messages. Except as set out in this Privacy Policy, we do not share email addresses or other contact information with third parties without your permission.
• Notifications: We will ask you if you wish to receive notifications about services that you request. If you agree, we will send you email or text messages to notify you about the status of your requests, such as product orders. We may also provide notifications about changes to our Services.
• Payments: Should any of our Services be provided for fees you may have the option to pay for Services via an electronic payment service. Such electronic payment service may be facilitated by a third party service provider on our behalf. Any payment information you provide may therefore be provided to such third party service provider, and you hereby provide consent to our disclosure of your payment information for that purpose.
• Uses in accordance with our Terms of Use, including administration of any user account you may have for the Services, helping you provide services to your customers, responding to your enquiries provided to us, and other uses relating to our Terms of Use.
• To improve customer service: Your information helps us to more effectively respond to your customer service requests and support needs.
• Legal and Regulatory compliance: Your information helps us to: (i) comply with our obligations as a regulated business; (ii) prevent crime; (ii) comply with anti-money laundering regulations and counter-terrorism financing regulations; and (iii) comply with requests for information from law enforcement, courts or regulators.
Do we disclose any information to outside parties?
We do not sell your Personal Information.
We may share some of the Personal Information we collect about you with third party companies, such as any Vibanx Group member, our trusted partners, affiliates and related entities, and our third party service providers, or other third parties which provide services or products similar to or complementary with your requested services or products, so long as those parties agree to keep your information confidential and to handle such information in compliance with applicable privacy laws. As examples, we may share your Personal Information with: (i) our business , suppliers and subcontractors, (ii) analytics and search engine providers that assist us in the improvement and optimisation of our sites and services; (iii) police and law enforcement agencies, where required to do so by law; and (iv) third parties with which we engaged in any transaction relating to a sale of our business or any assets.
Your Personal Information will also be shared to facilitate the services needed in order to properly and efficiently handle duties related to your requests and use of the Services. For example, we may share information with lawyers, accountants, and auditors. We may share your Personal Information with government agencies to fulfill legal, reporting, and regulatory requirements and we may release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect our or other’s rights, property, or safety.
We may also provide any of the Vibanx Group members, our employees, affiliated companies subsidiaries, and agents with your Personal Information so they may offer you Services, additional services or perform analysis to determine your qualification to receive future services. We may provide non-personally identifiable visitor information to other parties for marketing, advertising, or other uses.
How do we protect your information?
We implement a variety of security measures to maintain the safety of your Personal Information. We use physical, organizational and technical industry-standard security safeguards commensurate to the sensitivity of Personal Information and other data collected, used or disclosed. We have implemented and maintain reasonable and appropriate security measures, procedures and practices to protect against the loss and unauthorized access, use, modification, destruction or disclosure of your Personal Information while it is in our custody or under our control.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
NOTWITHSTANDING THE FOREGOING, THERE ARE INHERENT RISKS TO ANY TECHNOLOGY HOWEVER REMOTE THAT COULD CAUSE SECURITY PROTOCOLS TO FAIL OR TO BE BREACHED AND WHICH COULD RESULT IN THE UNAUTHORIZED COLLECTION, USE OR DISCLOSURE OF YOUR PERSONAL INFORMATION.
Do we use cookies, web beacons, log files, and similar technologies?
We may, from time to time, use cookies, web beacons, log files and similar technologies in relation to the Services. These tools are used to help us improve our Services, analyze usage trends, and provide tailored experiences to our users. We may further use such tools for security and authentication purposes.

Data Storage
We store your data in the European Economic Area (EAA) and in the United Kingdom (UK). However, some of our external third parties or our staff may be based outside the European Economic Area (EAA), so their processing of your personal data may involve a transfer of your data outside the EAA. Whenever we transfer your data outside of the EAA, we ensure a similar level of protection is afforded to it by ensuring one of the following safeguards is implemented:
(i) We will transfer your data to countries that have been deemed to provide an adequate level of protection (Adequacy Decision) for personal data by the European Commission.
(ii) Where we use certain service providers or our staff is operating outside of your country of residence, this is done so under relevant data protection laws, supported by specific contracts and/or clause wording approved by the European Commission (Standard Contractual Clauses) which gives your personal data the same protection it has in Europe.
The Vibanx Group members may transfer your personal information from the UK to Canada, and such transfers shall be in accordance with the safeguards set out in (i) and (ii) above.
If you are located in Canada, your Personal Information will be processed in accordance with this Privacy Policy and in compliance with applicable Canadian federal and provincial privacy law.
If you are located in the EU, we will comply with Regulation (EU) 2016/679 (the “EU GDPR”), or if you are located in the UK we will comply with the similar United Kingdom legislation, and if you are subject to such laws your provision and interactions with us must also so comply.
If such rights are provided to you under applicable laws, you may be able to exercise some or all of the following rights:
The Right to Know: The right to confirm whether we are processing personal information about you and, under applicable laws, to obtain certain details regarding the personal information we have collected about you, as set out in applicable laws.
The Right to Access & Portability: The right to obtain access to the personal information we have collected about you, and if permitted by applicable laws, the right to obtain a copy of such personal information.
The Right to Correction: The right to correct inaccuracies in your personal information, in light of the nature of such personal information and purposes for which such personal information is processed.
The Right to Control Over Sensitive Information: The right to exercise control over the collection and processing of certain sensitive information that we undertake.
The Right to Deletion: The right to have us delete personal information relating to you that we maintain.
The Right to Opt-Out of Sales or Sharing of Personal Information: The right to instruct us that we are not permitted to “sell” your personal information to third parties for either monetary or other valuable consideration, or to “share” your personal information with third parties for the purpose of cross-context behavioural advertising or targeted advertising purposes.

The Right to Restrict Processing: The right to request the restriction or suppression of your Personal Information. Note that this is not an absolute right and only applies in certain circumstances.
The Right to Object: The right to object to the processing of your Personal Information in certain circumstances, which may include an absolute right to stop your data from being used for direct marketing.
Retention of Personal Information
The period for which we will retain your data is dependent upon any statutory retention periods we are required to adhere to as a regulated organisation in the jurisdictions where we operate. Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.
When Personal Information is no longer required by us or by law, we will either convert it into an aggregated non-identifying form or we will appropriately destroy or erase the Personal Information in a manner that is in accordance with our current policies and procedures.
Children’s Privacy
We are committed to protecting the privacy of children. Our Services are not intended for children under 16 years of age. No one under age 16 may provide any information on the Services. We do not collect personally identifiable information from any person we actually know is a child. If we learn we have collected or received personal information from a child under age 16 without verification of parental consent, we will delete that information.
Information Accuracy
While we collect the Personal Information that you supply, we do so with the understanding that any such information is accurate. It is important to us that your Personal Information held by us is accurate and complete. Having accurate information about you enables us to provide you with the Services in a manner whereby they function as intended. We will bear no responsibility for any action or omission as a result of our lack of accurate contact information for you, including any inaccuracy, malfunction or other deficiency of the Services.
Access and Correction

Where applicable or permitted, we will make the information available within 30 days or provide written notice when we require additional time to respond to a request for access to information.
In some situations, we may not be able to provide access to certain Personal Information as the right to access Personal Information is not absolute. If we do not provide you with the requested information, we will notify you in writing and explain our reason(s) for not fulfilling your request.
Complaints
You make lodge a complaint with the Supervisory Authority in your country of residence.
Anti-Spam
Where applicable, we will seek your express consent to contact you, including by way of commercial electronic messages, which may include email, SMS text messages, or other electronic communication. You can unsubscribe at any time from receiving commercial electronic messages by following the instructions in the message or by contacting us at: compliance@vibanx.ca or by using the unsubscribe link provided in each communication.
Even if you have opted out of receiving marketing communications from us, please be aware that we may still contact you for other purposes. For example, we may contact you to provide communications you have consented to receive, regarding the Services we provide to you, or if you contact us with an inquiry.
Withdrawal of Consent
You may, at any time, withdraw your consent to our collection, use and disclosure of your Personal Information, subject to reasonable notice and any legal or contractual restrictions. Should you choose to withdraw your consent, we may be unable to provide, or continue to provide, the Services that can only be provided if we receive appropriate and required Personal Information.
Changes to our Privacy Policy
This Privacy Policy is effective as of the date indicated herein. We reserve the right to change this Privacy Policy, and any of our policies and procedures concerning our practices for handling Personal Information,
Policy will apply to both any Personal Information that we hold prior to the effective date of the amended Privacy Policy and any Personal Information that we collect on or after such effective date.
If we decide to change our Privacy Policy, we will post a notice of the changes on the Services and update the Privacy Policy modification date below. The modifications become effective immediately. You should review this Privacy Policy and all policies regularly to make sure that you are aware of any changes. Your access to use of the Services, our products and services on and after the date on which we post the revised terms constitutes your acceptance of the Privacy Policy as revised as well as of any revised policies.
Governing Law
All matters relating to your access or use of the Services shall be governed by: the laws of the Province of Ontario and the federal laws of Canada applicable therein if you are a resident of Canada; or the laws of England & Wales and the laws of the European Economic Area applicable therein if you are a resident of a country other than Canada, without regard to principles of conflicts of law.
Successors and Assigns
Our successors and assigns may collect, use and disclose your personal information for substantially similar purposes as described in this Privacy Policy.
